The Department of Higher and Further Education, Training and Employment[1], in exercise of the powers conferred by Articles 1(2) and 39(3) of the Employment Relations (Northern Ireland) Order 1999[2] and now vested in it, and of every other power enabling it in that behalf, hereby makes the following Order: Citation and interpretation 1. - (1) This Order may be cited as the Employment Relations (1999 Order) (Commencement No. 2 and Transitional Provision) Order (Northern Ireland) 2000. (2) In this Order "the 1999 Order" means the Employment Relations (Northern Ireland) Order 1999. Commencement 2. Subject to Article 3, the following provisions of the 1999 Order shall come into operation on 2nd February 2000 -
(b) in Article 35, paragraph (1) (to the extent that it is not already in operation) and paragraph (2); (c) Article 40 and the repeals specified in column 3 of Schedule 9 to the 1999 Order, to the extent specified in column 3 of the Schedule to this Order.
Transitional provision
The repeals specified in Part 10 of Schedule 9 to the 1999 Order, to the extent not already in operation (that is to say, Articles 23(2) to (4); Article 154(2); Article 158(2); Article 231(2); in Article 251(3)(a) the words "32(3)" and "154(2), 158(2), 159(7) and 231(2)" shall come into operation on 2nd February 2000. (This note is not part of the Order.) This Order brings into operation on 2nd February 2000 the provisions of the Employment Relations (Northern Ireland) Order 1999 ("the 1999 Order") specified in Article 2 of the Order, which relate to the uprating of certain awards of industrial tribunals and other sums payable under employment legislation. The Order also provides for the coming into operation of related repeals. (This note is not part of the Order.) The following provisions of the Order have been brought into operation by Commencement Order made before the date of this Order.
