The Secretary of State, in pursuance of section 64 of the Police (Northern Ireland) Act 1998[1] as amended by section 65 of the Police (Northern Ireland) Act 2000[2], and after consulting the Police Authority, Police Association and Police Ombudsman for Northern Ireland in accordance with section 64 of the 1998 Act, hereby makes the following regulations: - Citation and commencement 1. These regulations may be cited as the RUC (Complaints etc) Regulations 2001 and shall come into operation on 2nd May 2001. Amendment of earlier Regulations 2. - (1) The Royal Ulster Constabulary (Discipline and Disciplinary) Appeals Regulations 1988[3] shall be amended as follows -
(c) after Regulation 5(6) there shall be added -
(e) after Regulation 29(4)(b) there shall be added -
(f) after Regulation 29(6) there shall be added -
(2) The Royal Ulster Constabulary Reserve (Part-time) (Discipline and Disciplinary Appeals) Regulations 1988[5] shall be amended as follows -
(c) after Regulation 4(6) there shall be added -
(3) The Royal Ulster Constabulary (Conduct) Regulations 2000[6] shall be amended as follows -
(b) in Regulation 4, before the definition of "appropriate officer" there shall be inserted -
(c) in Regulation 7(2), at the end, there shall be added -
(4) The Royal Ulster Constabulary (Conduct) (Senior Officers) Regulations 2000[7] shall be amended as follows -
(b) in Regulation 7(2)(a), after "complaint" there shall be inserted "or allegation".
(5) The Royal Ulster Constabulary (Complaints etc.) Regulations 2000[8] shall be amended as follows -
(b) any matter under consideration by the Ombudsman under section 55 of the Act of 1998; and (c) any complaint referred to in Article 4 of the Police (Northern Ireland) Act 1998 (Commencement) Order (Northern Ireland) 2000[9]".
(b) in Regulation 25(1) -
(ii) paragraph (b) shall be omitted, and (iii) in paragraph (c), for "in either case that" there shall be substituted "and".
Interpretation
Application of regulations
(b) the complaint has not been informally resolved in accordance with Article 5 of the Order or section 53 of the 1998 Act; (c) the complaint has not been withdrawn within the meaning of Regulation 16 of the 1988 Regulations or Regulation 23 of the 2000 Regulations; (d) the complaint has not been dispensed with under Regulation 17 of the 1988 Regulations or Regulation 25 of the 2000 Regulations; (e) the complaint has not been otherwise dealt with under regulations made under 64(2)(d) or (e) of the 1998 Act, or (f) the complaint has not otherwise been investigated by the police.
Exceptions for certain complaints
(b) the complaint has not been informally resolved in accordance with Article 5 of the Order or section 53 of the 1998 Act; (c) the matter has not been withdrawn within the meaning of Regulation 16 of the 1988 Regulations or Regulation 23 of the 2000 Regulations, (d) the matter has not been dispensed with under Regulation 17 of the 1988 Regulations or Regulation 25 of the 2000 Regulations; (e) the matter has not been otherwise dealt with under regulations made under 64(2)(d) or (e) of the 1998 Act; or (f) the matter has not been otherwise investigated by the police.
Conditions to be met for other matters - being considered by the Ombudsman
(b) a statement has not been issued in respect of the disciplinary aspects of an investigation under Article 9(11) of the Order or section 59 (2) of the 1998 Act; (c) the matter has not been informally resolved in accordance with Article 5 of the Order or section 53 of the 1998 Act; (d) the matter has not been withdrawn within the meaning of Regulation 16 of the 1988 Regulations or Regulation 23 of the 2000 Regulations, (e) the matter has not been dispensed with under Regulation 17 of the 1988 Regulations or Regulation 25 of the 2000 Regulations; (f) the matter has not been otherwise dealt with under regulations made under 64(2)(d) or (e) of the 1998 Act; or (g) the matter has not been otherwise investigated by the police.
Exceptions for certain matters
(b) proved by the person presenting the case beyond reasonable doubt.
(2) Where a complaint or other matter relates to conduct by a member which occurred or commenced on or after 6th November 2000 the person considering the case shall not find that the conduct of the member concerned failed to meet the appropriate standard unless the conduct is -
(b) proved by the person presenting the case, on the balance of probabilities, to have failed to meet the standard.
(This note is not part of the regulation.) These regulations set out the circumstances in which the Ombudsman may investigate complaints (or other matters) depending on the date the police conduct in question took place and whether or not it has previously been dealt with. In general, the Ombudsman will be able to deal with cases not previously dealt with and arising from conduct in the previous 12 months. The regulations set out exceptions to this general rule. If there has been a delay in complaining and there are grave or exceptional circumstances and it appears that a criminal offence has been committed or an officer has behaved in a manner which would justify disciplinary proceedings then the Ombudsman may also investigate the case (regulations 6(1) and 9(1)). In addition, the Ombudsman may take on a case, even if it has been dealt with before, if there is new evidence, and it appears that a criminal offence has been committed or disciplinary proceedings justified and the matter is grave or exceptional (regulations 6(2) and 9(2)). There is also provision for any case which indicates a crime and which has either not been dealt with before or in respect of which there is new evidence even if the grave or exceptional test is not met (regulations 6(4) and 9(4)). Regulation 10 provides that the general period of 12 months shall be 24 months for the first year of operation of the Ombudsman's office. Regulation 11 sets out the standard of proof to be applied to different cases. The regulations refer to the Royal Ulster Constabulary. The references should be taken to mean the Police Service of Northern Ireland once the name is changed.
