The Department for Social Development, in exercise of the powers conferred on it by section 68(2)(a) of the Child Support, Pensions and Social Security Act (Northern Ireland) 2000[1] and of all other powers enabling it in that behalf, hereby makes the following Order: Citation and interpretation 1. - (1) This Order may be cited as the Child Support, Pensions and Social Security (2000 Act) (Commencement No. 7) Order (Northern Ireland) 2002. (2) In this Order any reference to a numbered section or Schedule is to the section of, or the Schedule to, the Child Support, Pensions and Social Security Act (Northern Ireland) 2000 bearing that number. Appointed days 2. - (1) The day appointed for the coming into operation of -
(b) section 45(1) (reports about winding-up) in so far as it inserts -
(ii) Article 72A(3), except for the words "Subject to paragraph (4)," and "(apart from any postponement under paragraph (4))", into that Order, and (iii) Article 72A(7), (8)(a) and (9) into that Order;
(c) sections 45(2) and (3) and 46 (directions for facilitating winding-up); and
for the purpose only of authorising the making of regulations is 1st March 2002 and for all other purposes is 1st April 2002.
(This note is not part of the Order.) This Order provides for the coming into operation of provisions of the Child Support, Pensions and Social Security Act (Northern Ireland) 2000 as follows - 1st March 2002 for provisions relating to the winding-up of pension schemes for the purpose only of authorising the making of regulations, and for all other purposes from 1st April 2002; and 1st March 2002 for provisions relating to investigations by the Pensions Ombudsman for the purpose only of authorising the making of rules. Article 3 amends the Child Support, Pensions and Social Security (2000 Act) (Commencement No. 6) Order (Northern Ireland) 2001 to revoke the day previously appointed for the coming fully into operation of provision for an alternative to the anti-franking rules relating to salary related contracted-out pension schemes. The impact on business of the commencement of provisions in the Child Support, Pensions and Social Security Act (Northern Ireland) 2000 is detailed in the Regulatory Impact Assessment relating to the Child Support, Pensions and Social Security Bill. The following provisions of the Child Support, Pensions and Social Security Act (Northern Ireland) 2000 have been brought into operation by earlier commencement orders as from the dates shown.
